Services may be delivered via third-party platforms (e.g. Zapier, Canva, Shopify integrations). We may update or improve our services at any time.

3. Your Responsibilities

By using our services, you agree to:

• Provide accurate and up-to-date information (e.g. business details, product info). 
• Ensure you have the rights to any content, images, or data you share with us.
• Use our services in compliance with all applicable laws and regulations.
• Not misuse, resell, or reverse-engineer our services.
   

4. Payments & Subscriptions

• One-off packages: Payment is due upfront at the agreed rate.
• Monthly subscriptions: Fees are billed in advance and renew automatically unless cancelled.
• All prices are listed in GBP (£) and may include VAT where applicable.
• You can cancel a subscription anytime; service continues until the end of the paid billing period. Refunds are not provided for partial billing cycles.
   

5. Intellectual Property

• All materials created by GiftSmart AI (campaigns, copy, templates) remain our intellectual property until full payment is received.
• Upon payment, you receive a non-exclusive licence to use the delivered content for your business.
• You retain ownership of your own brand assets, data, and customer information.
   

6. Data & Privacy

We handle personal data in accordance with our Privacy Policy. By using our services, you consent to our use of your information as described there.

7. Service Availability

We aim to provide uninterrupted services but do not guarantee that access will always be available or error-free. We are not responsible for downtime caused by third-party platforms, internet providers, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by law:

• GiftSmart AI is not liable for indirect, incidental, or consequential damages.
• Our total liability for any claims relating to our services is limited to the amount you paid us in the 3 months prior to the issue.
• We are not responsible for third-party platform issues (e.g. Facebook API downtime, Shopify outages).
   

9. Termination

We may suspend or terminate your access if you breach these Terms or misuse our services. You may also stop using our services at any time.

10. Changes to These Terms

We may update these Terms periodically. The latest version will always be published on this page with an updated date. Continued use of our services after updates means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
